Terms of Use

By downloading, accessing, or using Pagio ("the App"), you ("End-User") agree to be bound by these Terms of Use ("Agreement"). If you do not agree to these terms, please do not use the App.

Acknowledgement

This Agreement is concluded between you and Dmytro Lytvynenko ("Developer," "we," "us," or "our") only, and not with Apple Inc. ("Apple"). The Developer, not Apple, is solely responsible for the App and the content thereof. This Agreement may not provide for usage rules for the App that are in conflict with the Apple Media Services Terms and Conditions as of the date you accepted this Agreement.

License & Use

Scope of License

Subject to these terms, you are granted a non-exclusive, non-transferable, limited license to use the App on any Apple-branded products that you own or control, and as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions. The App may also be accessed and used by other accounts associated with you via Family Sharing or volume purchasing.

Restrictions

You agree not to reverse engineer, decompile, or attempt to derive the source code of the App.

Intellectual Property

App Ownership

The Pagio App, including its code, design, visual interface, and branding, is the intellectual property of the Developer and is protected by copyright laws.

User Content

You retain full ownership of the data, notes, and content you enter into the App. You are solely responsible for the accuracy and legality of the content you create.

Third-Party Intellectual Property Claims

You and the Developer acknowledge that, in the event of any third-party claim that the App or your possession and use of the App infringes that third party's intellectual property rights, the Developer, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.

The Developer's obligations under this section are limited to the extent required by applicable law. You agree to promptly notify the Developer of any such claim, cooperate with the Developer at the Developer's request, and not make any admissions or settlements without the Developer's prior written consent.

To the maximum extent permitted by applicable law, the Developer's total liability under this section shall not exceed the amount you have actually paid for the App.

Subscriptions & Payments

Pagio offers optional subscriptions and purchases processed exclusively by the Apple App Store.

  • Processing: Pagio does not process payments or store credit card information.

  • Renewals: Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period via your Apple ID settings.

  • Refunds: All refund requests must be submitted directly to Apple. We do not have the ability to process refunds.

Pricing and billing terms are governed by Apple's standard App Store policies.

Maintenance and Support

The Developer is solely responsible for providing any maintenance and support services with respect to the App, as specified in this Agreement or as required under applicable law. You acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the App.

The Developer may, at its sole discretion, release updates, bug fixes, or improvements to the App, but is under no obligation to do so.

The Developer reserves the right to modify, suspend, or discontinue maintenance and support services at any time and without prior notice.

Disclaimer of Warranties

The App is provided on an "AS IS" and "AS AVAILABLE" basis, without any guarantees of response time, resolution, or continued availability. The Developer makes no warranties, expressed or implied, regarding the App's reliability, accuracy, or availability.

We do not guarantee that:

  • The App will be error-free or uninterrupted.

  • Your data will never be lost (e.g., due to iCloud sync failures or device issues).

Pagio is a personal tool and is not intended for mission-critical record keeping.

In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be the Developer's sole responsibility.

To the maximum extent permitted by applicable law, the Developer's total liability under this section shall not exceed the amount you have actually paid for the App.

Product Claims

You and the Developer acknowledge that the Developer, not Apple, is responsible for addressing any claims you or any third party may have relating to the App or your possession and/or use of the App, including, but not limited to: (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.

To the maximum extent permitted by applicable law, the Developer's total liability under this section shall not exceed the amount you have actually paid for the App.

Limitation of Liability

To the maximum extent permitted by applicable law, the Developer of Pagio shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with your use of the App. In no event shall our total liability exceed the amount you paid for the App.

Legal Compliance

You represent and warrant that: (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

Third-Party Terms of Agreement

You agree to comply with all applicable third-party terms of agreement when using the App, including but not limited to your wireless data service agreement and any other relevant service terms.

Third-Party Beneficiary

You and the Developer acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of this Agreement, and that, upon your acceptance of the terms and conditions of this Agreement, Apple will have the right (and will be deemed to have accepted the right) to enforce this Agreement against you as a third-party beneficiary thereof.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of Poland, without regard to its conflict of law provisions.

Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the new Terms within the App. Your continued use of the App after such changes constitutes your acceptance of the new Terms.
